A proposed Bill is being considered by the Paraguayan Legislature seeking to make the terms in which a lawsuit is filed before the Exchequer Court. The objective of this Bill is to set the same term to file any lawsuit against administrative decisions. Currently, the timeframes vary according to the legal objective of the lawsuit. In IP matters, the Trademark Law establishes ten working days; in Telecommunication matters, the term is of fifteen working days; in Customs matters, it is of five working days, and in Environmental issues five working days. This causes a lot of confusion and disparity between the different parties, as the common term to reply to all these lawsuits is of eighteen working days. In a related case, the Supreme Court, by Decision N° 281 of June 6, 2001, declared Article 4 of Law N° 1462 that gave five working days to file the lawsuit to be unconstitucional and not applicable in that particular case. This Bill is aimed at granting the same term to all cases.
